A look at Homer Police Chief's lawsuit against town

By: Stephanie Claytor
Updated: March 3, 2013
Homer Police Chief Russell Mills is suing the town of Homer and its mayor, Alecia Smith, over the disbanding of the town's police department.

A hearing is set for Mar. 4 in the Claiborne Parish Courthouse.

In his lawsuit, Mills said he can't be fired as police chief because he was re-elected in 2010 as Town Marshal, and the town's charters states the Town Marshal shall serve as Chief of Police.

Chief Mills also claims the Homer Town Council violated the open meetings law when it voted to dismantle the police department. Chief Mills is also seeking a permanent injunction on abolishing the police department and reverting his position solely to Town Marshal. He also wants the mayor to pay him his full salary as police chief, and he wants the town to pay for his legal fees.
