An appeals court Thursday threw out malfeasance charges against the former Executive Director of the Bossier Office of Community Services.
The second circuit court says the charges were dismissed because Manuel Duque can`t be considered a public officer under Louisiana law.
That`s because the bocs is a private agency and you can`t be charged with malfeasance if you aren`t a public employee.
But Duque still faces accusations that he made personal purchases using a parish credit card.
Three other workers at the center were charged with similar crimes and the IRS is also investigating activities at the community services office.
